Dutch legal manuscript – Judicial Practice for the Raad en Leenhove of Brabant and the Lands of Overmaas – c. 1790–18 Interesting and extensive Dutch legal manuscript concerning judicial practice before the Council and Feudal Court of Brabant and the Lands of Overmaas. Manuscript title: “Judicieele Practijk voor den Raade en Leenhove van Braband en Lande van Overmaaze.” Netherlands, probably late 18th / early 19th century, c. 1790–1810. Large-format manuscript measuring approximately 34 × 22.5 cm, comprising 68 foliated leaves, written throughout in a remarkably neat and consistent hand in brown/black ink on laid handmade paper. The manuscript forms a systematic practical manual dealing with legal procedure before the Raad en Leenhof van Brabant en Lande van Overmaaze. It includes an extensive table of contents and treats numerous aspects of contemporary judicial procedure, including Mandament van Debite, Guarand, Indemniteijt, Injurien, Evocatie, Spolie, Maintenue, Complainte, Reformatie, Anticipatie, Appellation, Arresten and Recusatie, among others. A considerable part is arranged in a practical question-and-answer format (“Vraeg” / “Antw”), suggesting its use as a professional or educational legal reference work. The text contains references to earlier legal decisions and regulations, including explicitly dated references to 7 September 1734 and 24 April 1745. Watermarks and dating Of particular interest is the paper. Watermarks occurring in the written leaves themselves include the name: KLOPPENBURG as well as a large emblematic watermark incorporating the inscriptions: VRYHEIT – PRO PATRIA – … LIBERTATE The latter belongs to the well-known Dutch Pro Patria / Vryheit family of watermarks. Kloppenburg paper is documented around the turn of the 19th century; paper bearing the watermark J. Kloppenburg is specifically recorded as being manufactured by Carel Kamphuis of Epe in 1808. The dates from the 1730s and 1740s occurring within the manuscript therefore appear to refer to earlier legal sources rather than to the date at which this manuscript itself was written. On the basis of the paper and watermarks, a dating to the late 18th or early 19th century appears considerably more likely. Completeness The manuscript appears to be complete. The table of contents corresponds with the subjects and foliation present in the volume. The text continues through to folio 68, where the final section comes to an orderly end, with no apparent indication of missing continuation leaves. Provenance With a later illustrated ex-libris depicting the Madonna and Child and bearing the inscription: “Frater H. v.d. Zoete Moeder – den Bosch” together with an old handwritten inventory number. This may relate to the religious Fraterhuis De Zoete Moeder in ’s-Hertogenbosch, although this provenance has not been conclusively established. Condition In good condition considering its age and utilitarian character. The manuscript leaves are generally well preserved and the handwriting remains clear and highly legible. Some age-related staining, occasional spotting, handling marks and minor edge wear. The simple contemporary or early paper-covered boards show considerable wear, particularly to the spine, edges and corners, with losses and abrasions to the covering. An old handwritten title label survives on the front board. Please study the photographs carefully as they form an integral part of the condition description. An attractive and substantial manuscript source for the history of Dutch/Brabant legal practice, preserved on identifiable Dutch handmade paper with Kloppenburg and Pro Patria/Vryheit watermarks.
